Cop sues Cebu City vice mayor, PLEB execs for grave misconduct

CEBU CITY — For a move allegedly incongruent to an order of the Regional Trial Court, a policeman has filed criminal charges against the chairman and four members of the People’s Law Enforcement Board (PLEB).

Named in the complaint are Vice Mayor Michael Rama, who chairs the PLEB, and board members Sisinio Andales, Fritz Quiñanola, Pepita Jane Petralba and Auren Acuna.

Inspector Dominador Tubog accused the PLEB officials of grave misconduct and allegedly violating the Revised Penal Code.

In his affidavit, Tubog narrated that a certain Alfredo Abiera charged him with grave misconduct before the PLEB, for which he filed a motion to dismiss on May 11, 2001.

Tubog argued that complaints against any personnel of the Internal Affairs Service should be filed with the Inspector General’s Office of the National Police Commission.

Tubog added that Abiera has lodged a similar case against him with the Ombudsman for the Military.

However, the PLEB denied his motion to dismiss and subsequently denied his other motion for reconsideration.

Because of this, Tubog elevated the matter to the Regional Trial Court where he filed a petition for prohibition with a prayer for the issuance of a writ of preliminary injunction against the PLEB.

Tubog said the court eventually issued a writ of injunction or a continuing restraining order directing the PLEB to refrain from further action in the case against him.

Despite the court’s directive, the PLEB still allegedly went on with the administrative case and rendered a decision last May 20 finding Tubog guilty of gross misconduct and immorality.
