Ecija jail warden faces rape, abortion charges

CABANATUAN CITY, Nueva Ecija — A female inmate of the district jail here has filed four counts of rape and intentional abortion with the Office of the Ombudsman against the jail warden of Talavera town.

The complainant, Evan—geline Pineda-Yauco, 38, who is detained for estafa, accused Chief Inspector Roger Maliwat, Talavera jail warden, of raping her four times, getting her pregnant and later forcing her to abort her child.

Yauco filed the case through her lawyer, Rolando Bernardo. If found guilty, Maliwat could face the death penalty.

Yauco also filed an administrative case against Maliwat for alleged grave misconduct, oppression and abuse of authority.

Yauco was arrested for estafa on July 26 last year based on a warrant issued by then Regional Trial Court (RTC) Branch 23 Judge Andrews Amante.

The arresting officer, SPO2 Marcos Cayanga, however, advised the court of her arrest only on Sept. 18, or almost two months later.

Maliwat also ignored the court’s Sept. 26 order to turn over the inmate to the city jail here.

Yauco alleged that Maliwat raped her on at least four occasions: the first time last Oct. 24, twice in November and once last December.

She claimed the first incident took place inside Maliwat’s office in the Talavera jail. The three other alleged rapes happened at the Summerville Hotel in Baloc, Sto. Domingo town and at the Sarmiento motel in Talavera, she said.

Yauco claimed that Maliwat molested her at gunpoint and even threatened that she would be summarily executed ("salvaged").

When she got pregnant last January, she alleged that Maliwat took her to a certain Aling Ine in Barangay Calipahan, Talavera to undergo abortion.
