In Mandaue City, Measure seeks to ban ambulant vending

CEBU, Philippines - A Mandaue City councilor has drafted an ordinance which seeks to ban ambulant vending that employs moving vehicles for the purpose of selling goods anywhere in the city.

Councilor Jimmy Lumapas’ draft ordinance which shall be called the “Anti-Mobile Vending Ordinance of 2013,” states that it shall be unlawful for any person to engage in ambulant vending with the aid of any moving vehicle for the purpose of selling goods and other merchandise within the city.”

Lumapas, in his draft ordinance, states that it shall be unlawful for any person to engage in ambulant vending, with the aid of any moving vehicle, for the purpose of selling fruits and livestock animals and other merchandises using mobile vending vehicles such as multicabs and pedicabs.

Under the draft ordinance, violators will be fined.

For the first offense, P3,000 will be imposed.

The vehicle used shall be taken into custody. 

However, when the administrative fine is not paid after a 24-hour period, or upon the subsequent offense(s) thereof, the vehicle used for the commission of the offense shall be impounded in favor of the city government, and shall only be released to the owner upon payment of its corresponding towing fees based on the existing towing tariff rates of the TEAM, and in addition to an administrative fine P5,000.00, which shall be paid to the City Treasurer’s Office . 

And if under the 24-hour period, the goods and merchandise still remain in the custody of the city government for failure to pay such fine, it will be confiscated in favor of the city and to be turned over to proper institutions and penal establishments.

The City Legal Office, Traffic Enforcement Agency of Mandaue (TEAM), and the Mandaue City Police Office (MCPO) shall be asked to implement this ordinance to ensure strict compliance.

The ordinance was approved during yesterday’s council session and is referred to the committee on laws headed by Councilor Nenita Layese for review. — (FREEMAN)
