Carabuena seeks review of case

MANILA, Philippines - The motorist who was caught on tape beating up a Metro Manila Development Authority traffic enforcer is asking a Quezon City judge to order the reinvestigation of the direct assault case filed against him.
Robert Blaire Carabuena also asked the Metropolitan Trial Court Branch 42 Judge Juris Dilinila-Callanta to remand the case to the office of the city prosecutor, saying he and his brother, Robert Benjamin, were not “given ample time and reasonable opportunity” to prepare and submit their counter-affidavits.
Carabuena said Assistant City Prosecutor Victorino Badua rejected their counter-affidavits when they submitted them on Sept. 19, nine days after the deadline Badua set. He said they had difficulty securing statements of witnesses who were willing to be involved in the case.
Badua said he has given the defendants sufficient time to submit their reply to the allegations lodged against them.
