Ivler files human rights case vs Phl before UN body

MANILA, Philippines – Road rage murder suspect Jason Ivler has brought his case before the United Nations, claiming his human rights were violated from the time he was arrested up to the present.

The complaint cited purported violations of Ivler’s rights guaranteed under the International Covenant on Civil and Political Rights, to which the Philippines is a signatory.

Ivler’s family filed the complaint before the Committee on Civil and Political Rights of the UN Human Rights Council. It was sent via courier on Friday to Geneva, Switzerland, said Ivler’s mother, Marlene Aguilar-Pollard.

In the five-page complaint, a copy of which was furnished to reporters, Ivler’s camp said he experienced “inhumane and degrading treatment” by Philippine authorities.

The Philippine government was named as respondents. Ivler’s camp cited two law enforcement agencies – the National Bureau of Investigation (NBI) and the Philippine National Police – and the Quezon City regional trial court before which the murder case against Ivler is pending.

Ivler is facing murder charges for allegedly killing Renato Victor Ebarle Jr. during a traffic altercation on Nov. 18, 2009 in Quezon City. After a few months in hiding, Ivler was arrested by NBI agents at the house of his mother in Blue Ridge Subdivision last January.

Ivler was wounded during the shootout with NBI agents and underwent operation at Quirino Memorial Medical Center. He had a colostomy that allows him to defecate only through a bag and not through his anus. The suspect was confined at QMMC until a court ordered his transfer to the Quezon City Jail.

In the complaint before the UN, Ivler’s camp accused NBI agents, lead by Angelito Magno and Rosauro Bautista, of “unnecessarily and inhumanely” beating him even when he was already shot.

Ivler’s camp also protested the court’s order to have him committed to the “crowded and dirty” city jail “while his wounds were not yet healed and a colostomy bag is still attached to his abdomen.”

Ivler’s camp asked the UN to direct the Philippine government “to protect and respect the human rights of the accused.”
