Man seeks P2-M damage for deformed private part
A resident of Quezon City is seeking a P2 million damage suit against a well known surgeon and his clinic in Makati City for a faulty penile enlargement operation which resulted to deformation, with sagging bumps of his once medium size, well formed and functional sex organ.
Louem Martinez of Galas, Quezon City is set to file today a 14-page complaint through his lawyer Vicente Millora at the Quezon City Regional Trial Court against Dr. Manuel Calayan and his clinic, Calayan Surgical Center Corp. for the failed penile enlargement and widening operation which caused him “ untold pain and sufferings both physical and medical, anxiety and social humiliation.
In the 14-page damage suit, a copy of which was obtained by The STAR, Martinez alleged that the advertisement about the penile enlargement operations posted in the Internet by Calayan lured him to avail of the medical procedure. He said he read the ad while he was in the US and on April 18, he visited Calayan’s clinic in Makati City where the defendant allegedly boasted his ability to enlarge his penis as what were done to his satisfied clients since 2003.
Martinez said he underwent the surgical operation on Sept. 25, 2007 in exchange for P145,000 fee exclusive of consultation, laboratory and operation fees. He alleged that prior to the operation he was made to sign documents with fine prints which later on turned out to be an acknowledgement that there is no guarantee made by anyone regarding the operation procedure.
Prior to the operation, the complaint alleged that the penis of the defendant was medium size, well formed and has no functional problem. However, a day after the operation the plaintiff began to have high fever and his penis became swollen. He experienced severe pain in his private part and the surrounding areas near the sex organ.
Martinez alleged that when he returned to the clinic of Calayan he was given painkiller and a cream was applied to the affected organ. The cream he alleged was aquagel, a banned substance for penile operations, which complicated his condition. He alleged that he has to seek medical treatment from medical experts for the treatment of his devastated sex organ.
Instead of sympathizing with the patient, Calayan allegedly caused publication of various derogatory remarks that the cause of the failure of the operation was because of his sexual acts with his three girlfriends, which he said, was an outright lie.
The complainant said he filed criminal cases for perjury, estafa and obstruction of justice charges, which was dismissed confirming the allegation that the defendant is untouchable in Makati.
Martinez is seeking actual damage of not less than P 2 million moral and exemplary, that may be awarded by the court in the exercise of its sound discretion.
