Cigarette firms await court ruling on advertising ban

The Philippine Tobacco Institute (PTI), the umbrella organization of all cigarette manufacturers in the country, has reiterated its members’ support and compliance to Republic Act 9211, otherwise known as the Tobacco Regulation Act of 2003, especially with the recent ban on outdoor advertising which took effect last July 1.

PTI president Rodolfo Salanga said not a single tobacco billboard is left standing anywhere in the country, but noted that the Department of Health (DOH) insists the ban includes advertising materials like posters, leaflets and signages at a point-of-sale or retail outlets.

Salanga said their members have asked the Marikina Regional Trial Court to interpret the provision of RA 9211 covering the advertising ban to avoid confusion.

“Rest assured, we will comply with how the court will rule. With due respect to the DOH, what we seek here is a common, acceptable interpretation of the law,” he said.

In the meantime, Salanga called on all parties involved to recognize the jurisdiction of the court and respect the judicial system by observing the status quo.

Salanga refused to further comment on the merits of the case, citing the sub judice rule of the court.

“The Philippine Tobacco Institute welcomes government regulation of the cigarette industry. We believe that meaningful regulation strikes a balance among the interests of the public health sector, the tobacco growing community and the cigarette manufacturers and retailers,” he said.
