Talisay eyes private lot, to build barangay road

CEBU, Philippines - The Talisay City government is planning to expropriate an 862-square meter lot in barangay Mohon for public use.

Once the city has filed for expropriation, the court will then determine the property's reasonable valuation.

City Councilor Socrates Fernandez, who is the chairman of  the committee on public work and infrastructure, said the city government will purchase a portion of the lot that will be affected by the creation of a barangay road.

Barangay Mohon captain Dario Villaver, acting for and in behalf of Mayor Johnny De los Reyes, and in conformity with the procedural requirements, has already made an offer in writing to buy pertinent portions of parcels of land from the owners at P1,300  per square meter, the maximum value fixed by the City Appraisal Committee and the prevailing zonal value.

Fernandez said the owners of the parcels of land have refused to accept the offer made by the barangay captain.

But Fernandez said the City of Talisay, acting on its power of eminent domain as provided for in Section 19 of RA 7160, shall expropriate the parcels of land for the construction of a barangay road in sitio Libo, barangay Mohon, Talisay City.

The city government shall immediately take possession of the properties upon the filing of the petition for expropriation and upon making a deposit with the proper court based on the fair market value of the property as appearing in the current Tax Declaration. — (FREEMAN)
