Talisay SP supports committee assessment to hire consultants

CEBU, Philippines - The Talisay City council committee on laws has upheld the authority of the Bids and Awards Committee (BAC) to determine the necessity, practicability, and usefulness of hiring consultants in the government. 

This was the recommendation of the committee report submitted by Councilor Richard Francis Aznar, who is the chairman of the committee on law.

The BAC has suggested that Lolita Ylaya be hired as Mayor Johnny De los Reyes’ consultant for social services and special activities.  

Aznar cited Republic Act 9184 on the Revised Implementing Rules of RA 9184, Section 53 on Negotiated Procurement that “In the case of individual consultants or partnerships hired to do work that is (i) highly technical or proprietary; or (ii) primarily confidential or policy determining, where trust and confidence are the primary consideration for the hiring of the consultant: Provided, however, that the term of  the individual consultants or partnerships shall, at the most, be on a six month basis, renewable at the option of the appointing Head of the Procuring Entity, but in no case shall exceed the term of the latter.”

Aznar also said that all consultancy contracts shall be fixed price contracts and any extension of contract time shall not involve any additional cost. 

“The guidelines set forth by the law on procurement should be followed religiously, and as of the moment no authority can be given to the former pending the submission of the corresponding legal documents,” Aznar added.  (FREEMAN)
