CEBU, Philippines - A drug case filed against Talisay City Mayor Socrates Fernandez's son, Joavan, has been elevated to the Regional Trial Court (RTC).
Shabu in plastic packs were allegedly found in a car Joavan was allegedly driving, at that time the police were to serve an arrest warrant to him.
In an eight-page counter-affidavit, Joavan has claimed that the "supposed service" of the warrant of arrest on February 6, 2011 was not legal since he had already posted bail on February 4, 2011 and his released order was signed by Judge Manayon.
In his counter-affidavit, Joavan offers the defense of denial and frame-up.
According to prosecutor Sanchez, "the claim of Joavan that he was innocent can only be properly threshed out during trial and after a full blown hearing."— THE FREEMAN
