BENGUET, Philippines — Benguet lawmaker Eric Go Yap has urged the House of Representatives to address growing concerns about the rights of freelancers in the country, particularly to fill gaps in labor protection for graphic designers, writers, virtual assistants and programmers.

Without the same legal safeguards as regular employees, freelancers often face problems like delayed payments, unfair tax practices and the lack of benefits such as healthcare and paid leave, Yap said, prompting him to file House Bill No. 2856 or the Freelance Workers Protection Act. 

According to Yap, one of the key provisions of the bill is the requirement for written contracts between freelancers and clients. These contracts would clearly outline the terms of work, payment and deadlines, reducing the risk of disputes and ensuring both parties are on the same page.

“This is expected to protect freelancers from unfair treatment and confusion in work agreements,” the Benguet lawmaker said.

The proposal also seeks to extend certain employee benefits to freelancers, such as hazard pay and night differential pay when applicable.

“This would ensure that freelancers are fairly compensated for working in risky conditions or outside regular hours, which is often not the case under current labor laws,” Yap said.

The bill also includes penalties for clients who exploit freelancers by delaying payments or failing to meet contractual obligations. These penalties aim to create a more ethical freelance market, holding employers accountable and providing greater security for freelancers.

As freelancing grows in the Philippines, many workers are choosing this flexible way of earning a living. However, the lack of formal protections leaves them vulnerable to exploitation.

Yap hopes his proposal will level the playing field, giving freelancers the same legal rights and protections as full-time employees.

“If passed into law, House Bill 2856 could mark a major shift in how freelancers are treated in the Philippines, potentially serving as a model for other countries,” Yap said.

The bill would not only protect workers but also contribute to creating a fairer and more inclusive labor market for all, he added.
