SC denies Tatad's second MR to disqualify Poe

MANILA, Philippines — The Supreme Court (SC) on Tuesday denied the second motion for reconsideration filed by former Sen. Francisco "Kit" Tatad in the case of presidential aspirant Sen. Grace Poe.

Tatad earlier asked the high court to reverse its ruling to allow Poe to run for president in the upcoming elections.

The high tribunal denied Tatad's motion due to lack of merit and being a prohibited pleading.

Tatad filed the second motion for reconsideration, arguing that the ruling of the SC to allow Poe to run lacks "doctrinal value" as not all magistrates agreed that the presidential aspirant is a natural born citizen who complied with the 10-year residency requirement.

The petitioner also lamented that the high tribunal's decision to dismiss the first motion for reconsideration was not a sufficient explanation why Poe was allowed to run.

On April 9, the SC issued its decision with finality that Poe can run for president and cited that the motion for reconsideration filed by petitioners failed to present new substantial arguments to reverse their previous ruling.

"The Court resolved, by the same vote of 9-6, to deny with finality the said motions for reconsideration as the basic issues raised therein have been passed upon by this Court and no substantial arguments were presented to warrant the reversal of the questioned decision," the resolution read.
