MANILA, Philippines - The Commission on Elections (Comelec) Second Division on Wednesday declared presidential aspirant Rizalito David as a nuisance candidate.

David, a defeated senatorial candidate in the 2013 elections, filed the disqualification case against Sen. Grace Poe before the Senate Electoral Tribunal (SET).

The Comelec panel canceled David's certificate of candidacy (COC) for president for the 2016 national elections.

David recently filed a petition before the Supreme Court to reverse the decision of the SET that Poe is a natural-born Filipino.

The Comelec Second Division earlier disqualified Poe from the presidential race, citing "material misrepresentation" in her 2013 COC for senator.

Poe, however, has asked the Comelec en banc to reverse the decision of its second division on her disqualification.
