SC turns down another appeal vs. poltical dynasties

MANILA, Philippines - The Supreme Court on Tuesday  dismissed another petition seeking to prohibit political dynasties in the country.

The high court reportedly denied the petition by independent senatorial candidate Ricardo Penson, who requested for a judicial writ ordering Congress to enact a law prohibiting political dynasties.

According to the news report, the Supreme Court said it is beyond its authority  to order Congress to enact a law as the latter is  a co-equal branch of government.

The tribunal added that its denial of an earlier petition by businessman Louis Biraogo against succeeding political leaders from the same family was used as basis for the present petition's dismissal.

Biraogo requested the Supreme Court to order the Commission on Elections to block the candidacy of members of dynasties from the May 2013 midterm elections.

Penson also sought a clearer legal definition of the term "political dynasty" under the Omnibus Election Code and based on Article II Section 26 of the Constitution.

According to the provision, "The State shall guarantee equal access to opportunities for public service, and prohibit political dynasties as may be defined by law."
