'Mandatory presidential debate unconstitutional'

MANILA, Philippines – The proposal of the Commission on Elections (Comelec) to impose a mandatory debate for candidates in the 2010 presidential elections is unconstitutional and unnecessary, according to an election lawyer.

Atty. Romulo Macalintal said the poll body cannot order any candidate in the presidential elections to participate in debates.

“The Comelec can only invite candidates to the debate and cannot impose any sanction in case of non-appearance or refusal,” he pointed out.

He said the proposed mandatory debate will require constitutional amendments since the existing law does not provide such a requirement.
