Road rage suspect, Lim Jr., cleared

CEBU, Philippines —  David Lim Jr., the suspect in a road rage shooting incident in Cebu City last year, is now a free man.

 

This after the Regional Trial Court dismissed the criminal case filed against Lim for illegal possession of ammunition due to “insufficiency of evidence.” 

“Accordingly the instant case is hereby dismissed for insufficiency of evidence pursuant to Section 23 (1) of Rule 119 of the Revised Rules on Criminal Procedure,” the order reads.

Last year, the Cebu City Prosecutor’s Office charged Lim with frustrated homicide and illegal possession of ammunition for allegedly shooting Epraim Nuñal, a registered nurse, after a traffic altercation at 3 a.m. on March 19, 2017 along F. Sotto Street, Barangay Kamputhaw. 

Nuñal, a native of P. Cañezares St., Dumlog, Talisay City, suffered gunshot wounds to his right ankle and left thigh.

 “…this court, after having heard the testimonies of the witnesses for the prosecution and perused their documentary evidence, found the oral motion to be impressed with merit considering that the prosecution has failed to establish that the subject ammunition were recovered from the accused or within his immediate control as the prosecution has not presented an eye witness to the commission of the crime allegedly by the accused,” read the order penned by Judge Alexander Acosta of Branch 9.

 Acosta also lifted and recalled the hold departure order dated June 7, 2017 against Lim.

RTC Judge Ricky Jones Macabaya of Branch 5, who handled the frustrated homicide filed against Lim, earlier dismissed the case.

This came after Nuñal failed to attend the hearing of his case. — KBQ (FREEMAN)
