NBI: Rob suspect was moving while shot

CEBU, Philippines - Based on the autopsy of the National Bureau of Investigation, robbery suspect Ryle Alex Caburnay was a moving target when he was shot by PO2 Lea Juarez during a hot pursuit operation last June 7.

NBI medico-legal officer Dr. Rene Cam also said there was no way he was seated or lying down when he was shot.

Cam said the moving Caburnay may have assumed one of three possible positions when he was shot.

“Pwedi siya nagduko, nilikay or about to run…walay medical basis nga naghigda siya daan or naglingkod siya daan,” he said.

Cam found a single gunshot wound at the lower portion of the left anterior chest and just above the abdomen Caburnay, who was 17 when he died.

Cam added the bullet exited at the right lumbar area of Caburnay.

“The bullet hit from left to right,” he said.

He said the organs involved were stomach, pancreas and right kidney.

Cam also said Caburnay was shot from at least two feet away.

Commission on Human Rights investigator Rodulfo Paque said once they get a copy of the autopsy they will start gathering witnesses to corroborate the position of Caburnay when he was shot.

Last Sunday, the NBI exhumed the body of Caburnay at the Calamba Cemetery following the request of his family who claimed lapses on the part of Juarez.

CHR supervising investigator Primo Cadampog said the family of Caburnay asked for their assistance to investigate the incident claiming somebody told them he was shot even after he already surrendered to the police.

Caburnay was shot dead by Juarez after she and another policeman chased him to M. Velez St., Cebu City, after he allegedly robbed a woman working at the Cebu Business Park.
