Homicide raps filed vs. brgy. councilman

CEBU, Philippines - For waiving his right to answer the allegations filed against him, a barangay councilman was indicted by the Provincial Prosecutor’s Office for killing his brother-in-law.

Assistant Provincial Prosecutor Petronio Elesterio elevated the homicide case before the Regional Trial Court (RTC) after finding probable cause that the accused killed Marcon Genon.

Elesterio recommended P40,000 for the temporary liberty of the accused, Heracleo Pacquiao, 50, a barangay councilman of Upper Bugho, San Fernando town.

After the case was filed in court, the accused was able to post the recommended bail through surety bond.

The release order was signed by RTC Judge Eric Menchavez of Branch 21.

In the affidavit executed by Clarissa, wife of the victim, she said that on May 22, 2012, she was at South Poblacion of the said town when the incident happened.

She said she then went home after learning her husband was shot by the accused.

The victim was brought to the Carcar City District Hospital but was declared dead on arrival by the attending physician.

The victim died due to a gunshot wound.

After the incident, Clarissa said the accused voluntarily surrendered to barangay captain Pedro Sebial who then turned him over to the authorities.

SPO4 Ruben Reynes, the investigator of the case, told The Freeman prior to the shooting incident that there was a confrontation between the accused and the victim.

He added that based on the statement of Pacquiao’s family, it was the victim who drew the revolver but it was grabbed by the accused who then shot the victim once.— (FREEMAN)
