CEBU, Philippines - For asking money in exchange of facilitating the transfer of names in several land tax declarations, the anti-graft office has dismissed from service the revenue collection clerk of Malabuyoc town.
Graft investigator Llorene Grace Ompod found Emerito Devilleres guilty for violating Section 52 (a) (9) of the Revised Uniform Rules on Administrative Cases in the Civil Service.
Aside from the dismissal from service, Ompod likewise ordered the cancellation of eligibility, forfeiture of retirement and disqualification of respondent to reemployment in the government.
In the said complaint, Roque Tamayo, Pilar dela Peña, Alberto Devillerea, Conrado Leorque and Renidas Leorque stated that Devilleres asked money from them in exchange for facilitating the transfer of their names in tax declarations of the land they bought.
Complainants said they gave a total amount of P15,000 to Devilleres who failed to comply with his promises.
When they wanted to take back the money, complainants said Devilleres failed to return the said amount despite the existence of a promissory note which he signed before Attorney Amado Martinez.
Based on the complaint, Ompod summoned respondent to file his counter-affidavit but Devilleres failed to answer the allegations filed against him.
Based on the evidence submitted by the complainants, Ompod found that the respondent indeed asked for money from the complainants based on the promissory note he signed.
“It appears, however, that respondent broke his words again thereafter such that the money of complainants was never returned to them. Thus, reinforcing the presumption that respondent used complainant’s money for his personal use, gain and benefit,” decision reads.
Ompod likewise recommended the filing of five counts of estafa against Devilleres.— (FREEMAN)
