Sheriff turns to court on garnishment
CEBU, Philippines - Sheriff Eugenio Fuentes sought the help of the court to issue an order directing the Philippine Veterans Bank to deliver the judgment debt amounting to P13.3 million to Maurillo Rallos.
This is after the bank, which holds the funds of the City of Cebu, refused to comply with his directives.
Fuentes said he issued a notice of garnishment to the bank to garnish the deposits of the City of Cebu but was told the funds have already been allocated for certain projects. He said this claim is not supported by documents.
He said he made several follow-ups for the bank to deliver the garnished amount but the bank failed to deliver.
Fuentes then asked the court to “take whatever action it may deem legal, just and equitable under the premises for the purpose of expediting the execution” in the case of the heirs of Rev. Fr, Vicente Rallos against the City of Cebu.
This case is about the road that belonged to the Rallos family that is now being used as a road.
Meanwhile, Judge James Stewart Ramon Himalaloan of the Regional Trial Court Branch 9 denied the City of Cebu’s move to quash the writ of execution and to set aside the notice of garnishment for lack of merit. — (FREEMAN)
