Osorio case update: Prosecutors deny defense "proposals"

CEBU, Philippines - Prosecutors handling the murder case against the suspect in the killing of former prosecutor Patrick Osorio denied all “proposals” of the defense lawyers.

Private prosecutor Danilo Yap denied the proposal of defense lawyer Daryll Amante that his client, Lyndon Horandoy, was not given an opportunity to answer the allegations against him.

Amante said they will prove to court that Horandoy was denied of this opportunity when the case was called for preliminary investigation.

Yap also denied that there was no appraisal of the memoranda doctrine when Horandoy executed an extrajudicial confession.

Amante said they will present at least four witnesses in court during the trial of the case.

He reiterated that the extra judicial confession executed by his client will be declared as inadmissible as evidence in court after there was no appraisal of memoranda doctrine.

Yap will present at least one witness for the prosecution. He added he will adopt the evidences and testimonies of the earlier witnesses during the presentation of evidence against Horandoy’s allegedly accomplice Allan Senogat.

Yap said the prosecution will use Horandoy’s extra-judicial confession subscribed by a private lawyer as evidence in the case.

“The confession of Horandoy can strengthen the murder case filed against them,” Yap said.

Meanwhile, Judge Silvestre Maamo of Regional Trial Court Branch 17 will hold in abeyance the resolution of the case against Allan Senogat after Horandoy was arrested.

The case against Senogat was submitted for resolution after both parties rested the case.

The trial of the case will start on February 8.

Horandoy was arrested in the mountains of Barangay Guba, Cebu City August last month by virtue of the warrant of arrest issued by Maamo.

On January 6, 2009 Osorio was shot at the corner of Maria Gochan Street and N. Bacalso Avenue, Barangay Mambaling Cebu City. – (FREEMAN)
