Man charged for rude behavior at cemetery
CEBU, Philippines - The Provincial Prosecutor’s Office charged an American national in court for allegedly damaging the toilet equipment at the Manila Memorial Park in Barangay Poblacion, Liloan.
David Saxton Ullery was charged for malicious mischief before the Municipal Circuit Trial Court in Liloan-Compostela.
Prosecutor Petronio Elesterio recommended P6,000 for Ullery’s temporary liberty.
In a certification, Elesterio said Ullery was made aware of the complaint against him and was given the opportunity to submit counter-arguments, but Ullery reportedly chose not to avail of a preliminary investigation.
Provincial Prosecution chief Pepita Jane Petralba then approved the filing of the case against him.
In a joint-affidavit, security guards at Manila Memorial Park said they personally saw Ullery went unruly inside the rest room at the cemetery.
Kee Canceller and Emelito Gargasiran said they chanced upon Ullery when they were patrolling the cemetery at 4:10 pm last December 27, 2011. The American allegedly kept on banging the rest room door using a chandelier.
“However, as we observed him, he believed to have been under the influence of liquor or any intoxicated beverage due to his unusual behavior, as he directly went to destroy maliciously the lavatory, the water closet cover, faucet and broke the window glass of the comfort room,” the joint-affidavit reads.
They said they tried to stop Ullery from doing further damage but failed to do so as he is bigger and stronger. This prompted them to call assistance from the Lilo-an police.
It was SPO1 Jamie Marolina who led other policemen in arresting Ullery and in bringing him to the police station for proper disposition.
The guards said the damage to the rest room was estimated at P5,000. (FREEMAN)
