Winston Garcia, state auditors settle case
CEBU, Philippines - The Regional Trial Court has dismissed a civil case filed by former Government Service Insurance System (GSIS) head Winston Garcia against state auditors.
Judge James Stewart Ramon Himalaloan, Acting Judge of RTC Branch 9, dismissed the case after Garcia and the four auditors of the Commission on Audit agreed on a settlement.
“Plaintiffs and defendants by and through their respective counsel to this honorable court, jointly and respectfully move to dismiss the complaint and counterclaim on the ground that plaintiff and defendants have amicably settled the case,” order reads.
Garcia, brother of Cebu Governor Gwendloyn Garcia, filed damage suit against the state auditors in 2005 after he and other GSIS officials were indicted for alleged violation of the Anti-Graft and Corrupt Practices Act.
COA’s 2004 audit report cited several anomalies at GSIS. But Garcia said he was offended by the findings of COA and the same had ruined his reputation.
The defendants in the case were Joel Estolatan, Rhoda Pilena, Raquel Habitan, Alexander Juliano and Rosalinda Salvador. — (FREEMAN)
