Gubalane files perjury raps

CEBU, Philippines -  Regional State Prosecutor Fernando Gubalane filed a complaint for perjury before the Cebu City Prosecutor’s Office against Brenda Tan, the woman who accused him of graft before the Office of the Ombudsman-Visayas.

Gubalane said Tan should be accountable for her act of filing a complaint for grave misconduct against him.

“She must be mindful that the complaint was made under oath and she must be accountable for it,” Guba-lane said.

Gubalane, in his counter-affidavit, said he has a certification to prove that he did not receive allowances from Danao City, Bogo City and the Witness Protection Program (WPP).

“Respondent Tan knew very well that her declaration under oath to the effect that I demanded and received monthly allowances from Bogo, City, Danao City and WPP is an absolute falsehood precisely why she never bothered to substantiate such allegations with pertinent documents that could be readily secured from said offices,” said Gubalane in his affidavit.

Tan had said he was receiving monthly allowance totaling P92,400, which is beyond limits. But Gubalane stressed this is not true.

He explained the allowances he received were legal and allowed by the Local Government Code, City Ordinance and Section 16 of Republic Act 10071 or the prosecution service act of 2010.

Earlier, Tan, of Sitio Butterfly, Barangay Babag I, Lapu-Lapu City filed complaints before the Office of the Ombudsman for Guba-lane’s alleged illegal receipt of monthly allowances from local government units and the National Government. — (FREEMAN)
