Mabanto documents show Japanese as "undesirable"

CEBU, Philippines - Mandaue City Prosecutor Bienvenido Mabanto, Jr. yesterday presented seemingly incriminating police records of a Japanese national who has claimed to have been attacked by the prosecutor.

Mabanto said the records were lifted from a police blotter in Sogod, Southern Leyte which would show that Japanese national Tamotso Miyauchi as an "undesirable alien."

Miyauchi once lived in Sogod.

An extract from the blotter dated December 20, 2010 and noted by Police Chief Inspector Feliciano Romero, Jr. states the following:

"On September 26, 2008, page no. 0066, Entry No. 394 stated that Nielita Pacate, 37 years old, resident of the said town alleged that she was slapped and boxed by her live-in partner named Tamotso Miyauchi on September 22, 2008. She sustained contusion hematoma in the different parts of her body based on the medical examination.

"On March 29, 2010, page no. 0101, Entry No. 561 states that Rachelle Ann Capapas, 18 years old, told police station that their neighbor Tamotso Miyauchi came to their house in an angry manner and told her to kneel down and she was forced to ask for forgiveness out of fear.

"On March 31, 2010, page no. 010, entry No. 562, barangay captain Natividad Catibag reported to the police station that Nielita Pacate-Miyauchi, was mauled by her husband, Tamotso Miyauchi. When the police arrived at their house, the husband was already gone. The wife sustained multiple hematoma.

"On April 10, 2010, page no. 0103, Entry no. 569 stated that the police station received a call from a concerned citizen that a certain Tamotoso Miyauchi has made a commotion/alarm scandal at their residence which cause panic to neighbors.

On April 8, 2010 in Macrohon, Southern Leyte, the Macrohon Municipal Police Station also certified that the same Japanese national also raised alarm and scandal in the town."

Mabanto filed a complaint for direct assault to a person in authority, malicious mischief, and physical injuries against Tamotso Miyauchi the other day in the Mandaue City Prosecutor's Office.

Mandaue City Assistant Prosecutor Felixberto Geromo in his Inquest Memorandum the other day recommended that corresponding information be filed in court after he found probable cause to charge Miyauchi for direct assault and malicious mischief.           While the complaint for physical injuries is absorbed in direct assault Mabanto and Miyauchi figured in a heated verbal altercation in the middle of M.C. Briones Street last Friday, which eventually led to the mauling of the latter, for which according to Mabanto, it was the bystanders who mauled Miyauchi.

Both parties sustained injuries in the different parts of their bodies. (FREEMAN)
