Uncle sues nephew for attempt on his life

CEBU, Philippines – A laborer faces charges before the Regional Trial Court for frustrated homicide for allegedly hacking and wounding an uncle in 2009 in barangay Buhisan, Cebu City.

Virgilio Tampus, 36, a welder by profession, and a resident of sitio Kalumbuyan, barangay Buhisan, Cebu City sued his nephew Alberto Tampus, 26, a laborer, for an attempt on his life.

Prosecutor Anna Lou Cavada recommended a bail of P24,000 for Alberto's temporary liberty.

Cavada said she has found probable cause to elevate the case to the court when the accused failed to submit any controverting evidence.

Virgilio said that on November 26, 2009 at around 12:30 p.m. he was inside their house when he heard stones thudding on the roof of their house.

He said when he looked outside he saw his nephew throwing stones at his house.

He said when he admonished his nephew by saying "ayaw pamato diri sa balay Al kay makaigo ka og bata." His nephew got mad and went inside his house armed with two "bolos."

Virgilio Tampus said when he sensed he was in danger he quickly went outside the house through another door.

But Alberto caught up with Virgilio and hacked him, hitting him on the back.

He said Alberto swung his bolo again and again hitting his head, right armpit, and his right palm.

Though wounded, Virgilio was able to disarm his nephew.

When his nephew was lying motionless, he said he got the bolo and was about to strike Alberto when his two nieces Agnes and Maricel begged him to drop the weapons to the ground.

Virgilio said his two nieces took him to the Cebu City Medical Center, leaving Alberto behind.

He later fled and has gone into hiding.

Prosecutor Cavada said she has sent a subpoena to the accused but he has failed to answer. (FREEMAN)
