Basak church sues couple
CEBU, Philippines - Holy Cross Parish Church in Barangay Basak-Pardo filed a complaint against a couple after allegedly damaging properties built by the church which the defendants have allegedly opposed to.
The said parish filed a civil case against American citizen Michael Casey and his wife Adora Dy and sought an injunction with temporary restraining order after the former allegedly destroyed padlocks of the church’s gate and also destroyed the gate as well.
In the plaintiff’s complaint, it stated that they constructed a fence in 2008 considering that it would be fine since they are registered owners of the lot where the church stands.
But as the construction of the fence proceeded to the adjacent lot owned by the couple, they opposed. However, the parish provided a pathway for the public as well as a gate for the temporary passage of the couple’s vehicle.
After which, the defendants transferred residence so the plaintiff decided to lock the gate but was allegedly destroyed by the Caseys for several times.
Recently, the parish decided to replace the gate with a concrete fence but Casey also allegedly filled up the excavated groundwork.
Casey also, after destroying one of the gates, parked his car in the said location to stall the cementing of the fence. The plaintiff pointed out that Casey was invading their privacy which has pushed them to file the complaint.
The parish denied that it was not true that the property was a public plaza since the lot was sold to them by the owner and that they have copies of the deed of sale to prove it.
With this, the parish said they hope that a writ of permanent injunction be issued against the couple enjoining them from committing acts of intervention in the construction of the concrete fence and pending the hearing of the permanent injunction a preliminary injunction also to be issued against the two to avoid further acts of intervention in the parish’s fence construction. – AJ de la Torre/MEEV (FREEMAN NEWS)
