Court clears man of robbery charges
A man was ordered released from jail after he was cleared of robbery charges because of the complainant’s faulty testimony.

In her affidavit, Araojo claimed that she caught Barot inside her house in the act of stealing a stereo component, a car battery, three big cooking pots, an aluminum pot and a basin.
Aside from that Araojo also claimed that Barot threatened to kill her and she ran off, when she went back the accused was allegedly gone along with her belongings.
But Regional Trial Court judge Estela Alma Singco yesterday ruled that Araojo was lying because while she initially claimed that she caught the accused in the act, upon cross-examination Araojo admitted that she only heard that it was Barot who took the missing items.

Singco doubted the credibility of Araojo because while she claimed in her testimony that she caught Barot inside her house stealing her personal belongings, she failed to tell this same story when she went to the police station to have the incident recorded.
“The excerpts of the police blotter had no mention of Salvacion having caught the accused in the act of stealing her personal things. The prosecution’s story concerning the robbery is difficult to accept. The court is baffled why she did not shout for help considering that there were neighbors around,” the decision read. — Rene U.
