Hearing on Solima petition vs Faelnar set next week

The court is expected to hear the petition filed by lawyer Salvador Solima asking it to stop Guadalupe barangay captain Eugenio “Jingjing” Faelnar from seeking reelection for the presidency of the Association of Barangay Councils next week.

Judge Eric Menchavez has been tasked to hear the petition considering that the ABC election is scheduled on December 29.

The Office of the Clerk of Courts under lawyer Jeoffrey Joaquino yesterday forwarded to Regional Trial Court Branch 21, which is presided by Menchavez, all the documents involving the petition filed by Solima.

Solima had claimed that Faelnar has no right to continue holding the ABC’s top post pending the resolution of his motion for reconsideration on the disqualification case he filed against Faelnar.

The case was already dismissed by the Second Division of the Commission on Elections for lack of merit. But Solima quickly filed a motion for reconsideration of the dismissal of his complaint.

In his complaint, Solima insisted that Faelnar was already in his third and last term and was not qualified to run in the October 29 synchronized barangay and Sanguniang Kabataan elections. But the Comelec ruled that Faelnar can still run because his term was interrupted when he was suspended by the Sandiganbayan.

Solima told dyLA that while the Comelec still failed to resolve his motion for reinvestigation, its ruling dismissing his disqualification case against Faelnar is still not final.  — Rene U. Borromeo/LPM
