University teacher charged with rape

A university teacher who was accused of raping one of his students has been charged with rape before the court.
Cebu City prosecutor Nicolas Sellon has approved the indictment of Gilbert Fuensalida Lumanog for rape following his failure to answer the allegation.
Lumanog, a resident of Poblacion, Pinamungajan town and a physical education instructor at the University of Southern Philippines-Mabini campus, was accused of raping his 16-year-old fourth year student around 2:30 p.m. on August 15, 2005.
The victim claimed the rape happened while they were having their P.E. class at the ground floor of the university building. The accused reportedly required his students to demonstrate the cardiopulmonary resuscitation one at a time inside his office using a human dummy.
But when it was already the victim's turn to do it, Lumanog allegedly locked his office and told the victim to apply the CPR on him instead of applying it to the dummy.
Since the CPR involves a mouth-to-mouth contact, the victim was at first reluctant to perform but was later forced to do it.
According to the victim, she avoided a lips-to-lips contact with the accused when she demonstrated the CPR, but Lumanog told her that it was not the right thing to do it and instead demonstrated the CPR on her.
When the victim lied down on the bench, Lumanog allegedly held her nose and opened her mouth and started kissing her. The accused even allegedly repeated the procedure thrice.
Lumanog then allegedly got up from the bench, grabbed the victim's hair and started kissing her neck while subsequently pushing her back against the wall.
The accused allegedly took off her underwear and then raped her. The victim said she tried to shout but Lumanog covered her mouth with his hands.
She said she escaped when the accused tried to make her lay down on the bench and immediately reported the incident to her class adviser who also reported it to her parents.
A medical examination result revealed that there was a shallow penetration on the victim's genitals.
