City Prosecutor Joaquin T. Escobar, on recommendation of Prosecutor III Apolinar C. Quetulio Jr., approved the indictment of Ms. Siy in relation to the complaint filed by her siblings George T. Siy, Jacqueline Siy-Share and Angeline Siy-Feichter relative to the use of "26 postal registry receipts (that) were fake and never sent thru the Fort Bonifacio Postal Office."
The sending of the postal registry receipts that were later disavowed by the Fort Bonifacio Post Office formed the basis for the complaints lodged by George and his sisters Angeline and Jacqueline in connection with the supposed holding of a stockholders meetings of various Siy-owned firms that include Kenny Rogers, Seattle’s Best, and Popeye Chicken.
The sending of the postal registry notices according to the prosecutor’s office, was made "to the prejudice and detriment and damage of the complainants" George, Jacqueline and Angeline.
In connection with the charge of perjury, Bernadine was indicted since she averred to the truthfulness of a court filing that was "administered under oath" before Mia Carissa C. Martin regarding the postal registry notices although she was aware that it was false and that the receipts were fake.
Dropped from the perjury charge were Wilfred and Frederick Siy since the prosecutor’s office said Bernadine "alone verified the complaint."
However, the prosecutor’s office sought the inclusion of Wilfred and Frederick in the filing of the charge of falsification of public documents.
The filing of the charges bolstered the assertion of George and his two sisters that the holding of the stockholders meeting which took them out of their board representatives is flawed, necessitating the filing of the complaints.
