Go, Padilla humirit sa SC: Ibalik 16-vote threshold

MANILA, Philippines — Umapela sa Korte Suprema sina Senador Robin Padilla, Senador Christopher “Bong” Go, PDP-Laban, at ilang abogado at mamamayan upang ibalik ang 16-botong requirement para mahatulan sa impeachment si Vice President Sara Duterte.

Sa petisyong inihain noong Oktubre 6, iginiit ng mga petitioner na malinaw sa Konstitusyon na kinakailangan ang boto ng 2/3 o 16 ng lahat ng 24 senador upang magkaroon ng conviction sa isang impeachment case.

Kinukuwestiyon nila ang naging desisyon ng Senate Impeachment Court noong Setyembre 23 na pahintulutang ibatay ang two-thirds requirement lamang sa mga senador na itinuturing na legal at factually capable na lumahok sa paglilitis.

Ayon sa petisyon, malinaw na nakasaad sa Saligang Batas ang pariralang “two-thirds of all the Members of the Senate” at hindi two-thirds lamang ng mga present, bumoboto, o kwalipikadong lumahok.

Pinangalanang respondents sina Senate President Sherwin Gatchalian, Sen. Francis Escudero, House Speaker Faustino “Bojie” Dy III, at ang House Prosecution Panel sa pangunguna ni Rep. Gerville Luistro.

Hinihiling ng mga petitioner sa SC na maglabas ng Status Quo Ante Order o Temporary Restraining Order upang ibalik ang 16-botong threshold sa impeachment conviction.

Babala pa nila, maaaring magkaroon ng malawak na implikasyon sa mga susunod na impeachment proceedings kung papayagang mabago ang itinakdang supermajority requirement batay lamang sa ­attendance o partisipasyon ng mga senador.
