Petisyon laban sa housing project, ibinasura ng Court of Appeals

MANILA, Philippines - Ibinasura ng Court of Appeals (CA) ang petisyon ng isang abugado na mapahinto ang pagtatayo ng housing units sa bahagi ng Estero de Abad sa Maynila.

Sa 9-pahinang desisyon ng CA Special 18th Division, hindi pinagbigyan ang petition for issuance of Writ of Kalikasan  at hiling na magpalabas ng Environmental Protection Order  upang mapahinto ang tuluyang pagkasira ng kapaligiran sa Estero de Abad na inihain ni Atty. Reynaldo Bagatsing laban sa housing projects dahil sa kawalan ng merito.

Nabatid na sa pamamagitan ng isang resolution, pinayagan ng City Council si dating Manila Mayor Alfredo Lim na pumasok sa Memorandum of Agreement (MOA)  na may petsang Enero 6, 2008 para sa pagtatayo ng tatlong medium high-rise buildings  na  may 700 housing units.

Iginiit naman sa apela ni Atty. Bagatsing na ang sanhi ng mga pagbaha sa Maynila ay dulot ng sinasabing iligal na construction ng bahay sa may 47-estero, creek,  at waterways.

Kabilang sa defendants  sa petis­yon ang alkalde, Metropolitan Manila Development Authority (MMDA), City’s Office of the Building Official (OBO), Department and Public Works and Highways (DPWH), Empire East Properties, Inc., Harisson M. Paltongan at si Antonio T. Tan.

Sa desisyon ng CA, isang “mere conjectures and speculations” lamang ang sinasabi ni Atty. Bagatsing.

“After a careful study of the alle­gations in the petition and the evidence presented by the parties, the court finds no basis to grant the present petition,” anang CA.
