Desisyon ng SC sa DAP pinuri ni Miriam
MANILA, Philippines - Ikinatuwa kahapon ni Senator Miriam Defensor-Santiago ang ipinalabas na desisyon ng Supreme Court na nagsasabing labag sa Konstitusyon ang Disbursement Acceleration Program (DAP) ng administrasyong Aquino.
Ayon kay Santiago, inaasahan na niya ang naging desisyon ng Kataas-taasang Hukuman lalo pa’t mistulang tinatanggal ng DAP ang “power of the purse” ng Kongreso.
“It’s basically a no-brainer. The DAP is illegal because it was not contained in the 2011 or 2012 budgets, and because the alleged savings were used to augment new budget items which was not previously authorized by Congress,” ani Santiago.
Maliwanag aniyang nalabag sa DAP ang constitutional provision na: “No law shall be passed authorizing any transfer of appropriations; however, the President, . . . may, by law, be authorized to augment any item in the general appropriations law for their respective offices from savings in other items of their respective appropriations.”
Ipinaliwanag ni Santiago na pinapayagan lamang ng Konstitusyon ang pagta-transfer ng pondo kung mayroong savings o natirang pondo sa isang nakumpleto ng proyekto.
Pero hindi aniya maituturing na savings ang pondo para sa isang ipinagpaliban lamang na proyekto.
