“Clearly, there was no double sale at all. The respondent (BCDA’s Casanova) committed perjury when he swore and subscribed to his Complaint-Affidavit dated 9 March 2012 falsely claiming that there was. The allegation as to the existence of the supposed double sale is a material matter because the alleged concealment of the prior sale to Wilson Sy and the transfer of the same subject property to BCDA by way of dacion en pago -- which BCDA supposedly would not have consented to had it known of the earlier transaction -- is the purported fraud upon which the complaint for estafa depends for its efficacy.”
