Ang disqualification case nitumaw human usa ka Allen Canoy, residente sa Barangay Apas, nisang-at og petisyon sa pagkanselar sa kandidatura ni Arcilla kinsa nakahuman na sa tulo ka sunod-sunod nga termino gikan sa 2010-2013, 2013-2016 ug 2016-2019.
Si Arcilla niingon nga ang iyang serbisyo naputol dihang gisuspenso siya sa katungdanan gikan sa May 17, 2016 hangtud sa Hunyo 30, 2016.
Apan niadtong May 28, ang En Banc niuyon sa resolution sa Comelec First Division nga nagkanselar sa kandidtura ni Arcilla ug ang En Banc niresolbar ug nibasura sab sa motion for reconsideration niini.
Si Comelec Cebu City North District Election Officer, Atty. Marchel Sarno, niingon nga karon ang saktong panahon nga si Canoy mosang-at og motion for execution sa Comelec En Banc.
Kini aron maproklamar ang ika-siyam nga konsehal nga si Konsehal Jerry Guardo.
