STC miinsister nga way hurisdiksyon ang hukom sa kaso sa mga tinun-an

- Brenda Batuto -

Ang paragraph 1 sa nahisgutang manifestation nagkanayon kini nga “As now acknowledge on record by the Honorable Wilfredo F. Navarro, the Regional Trial Court Branch 19 has no jurisdiction over the case. Indeed, at first blush, and by simply reading the “Petition”, the lack of jurisdiction of RTC 19 is evident. The caption indicates it is a case involving minor. Under Republic Act 8369, it is the Family Court that has exclusive original jurisdiction to hear and decide cases involving alleged violations of RA 7610 (Section 5 (j)).

“Being void, STC cannot even be accused of defiance of said TRO, The Supreme Court is very emphatic that there can be no contempt for disobedience of an order issued without authority,” tipik sa paragraph 4 sa manifesto.  - BANAT NEWS
