MANILA, Philippines - Kakasuhan ng isang election watchdog ang Commission on Elections (Comelec) dahil sa umano'y palpak na automated poll system.

Sa United Nations Human Rights Committee sa Geneva, Switzerland pa maghahayin ng reklamo ang Automated Election System (AES) Watch kasama ang Concerned Citizens Movement (CCM).

"For not ensuring the free expression of the voters’ will under the defective Automated Election System, the Comelec through the Philippine Government is being charged for violation of international law, to which the government is a signatory," pahayag ng AES Watch.

Sinabi naman ni UP Law Professor at international law expert Harry Roque, isa sa mga nagrereklamo, sa kanyang blog na ang depekto ng precinct-count optical scan (PCOS) machines ay labag sa Article 25 ng International Covenant on Civil and Political Rights.

Ang nasabing probisyon ay pasok sa karapatang bumoto at lumahok sa gawaing pampubliko ng isang Pilipino.

Ayon sa AES Watch, pangungunahan ng kanilang 30 miyembro, kasama ang kilalang personalidad, ang paghahayin ng reklamo.

Ilan dito ay sina dating bise-presidente Teofisto Guingona, Jr., Bishop Broderick Pabillo, Martin Dino ng Volunteers Against Crime and Corruption, Dr. Temario Rivera at Dr Pablo Manalastas ng Center for People Empowerment in Governance (CENPEG), at Fr. Jose Dizon at Renato Reyes ng grupong Kontra Daya.

Sinabi pa ni Roque na ang CCM ang unang grupong nagkuwestiyon sa PCOS machine ng Smartmatic dahil anila' hindi ito naaayon sa saligang batas.

"It (CCM) alleged that the paper based counting system violates the right of the people to ensure that their votes are correctly recorded by the PCOS machines," sabi ni Roque sa kanyang blog.

Samantala, nauna namang inihayag ng CenPEG na karapatdapat kiwesityunin ang kredebilidad ng eleksyon dahil sa hindi pagsunod nito sa Automation law.

“Today, more election cheats are expected to have mastered the crime of computerized fraud and be able to get away with it especially in the light of the election system's disturbing vulnerabilities and the absence of a clear adjudication process,” sabi ni Bobby Tuazon, direktor ng CENPEG para sa policy studies at AES Watch co-convenor.

Pinuna pa ni Tuazon ang hindi pagsasagawa ng source code review, kakulangan ng lisensya upang gamitin ang sistema at ang hindin paggamit ng mga pangunahing safety features ng PCOS machines.

Binanatan naman ni Comelec Chairman Sixto Brillantes ang mga kritiko ng poll body at sinabing nais lamang ng mga grupo na isabotahe ang eleksyon.

"The continued assertion of falsehood by AES Watch, CENPEG et al aims nothing but to sow public mistrust & sabotage the upcoming elections,” sagot ni Brillantes sa kanyang Twitter account.

Kahapon ay nagpahayag si Brillantes sa mga kritiko ng Comelec na dapat at may maaga pa idinulog sa kanila ang reklamo at hindi kung kailan nalalapit na ang eleksyon.

"The critics have been surfacing now [when the election day] is near... It seems that there is an orchestrated [effort] to cast doubt into this election," sabi niBrillantes sa isang panayam sa radyo.
