Roque: Airstrike ng Malaysia labag sa int'l law
MANILA, Philippines – Labag sa batas ang ginawang air strike ng Malaysia sa royal army ng Sultanato ng Sulu, ayon as eksperto sa international law ngayong Martes.
Sinabi ng abogadong si Harry Roque ng Institute of International Legal Studies sa University of the Philippines, nilabag ng gobyerno ng Malaysia ang international na batas.
"Under human rights law, the use of force in police operations should be absolutely necessary and strictly proportional to the threat posed by the Filipinos in Sabah," pahayag ni Roque.
Aniya, gumamit ng labis na puwersa ang Malaysia sa pagpapaalis sa mga miyembro ng royal army na nananatili pa rin ngayon sa Lahad Datu.
"Respect for the right to life of a police suspect requires that the nature and degree of force used be proportionate to the threat posed by the suspect to the safety and security of the police officers, other individuals and society as a whole,†sabi ni Roqueâ€
"Malaysian law enforcement officials should, as far as possible, apply non-violent means before resorting to force, and in particular, the resort to airstrikes," dagdag ng abogado.
Nanawagan si Roque sa gobyerno ng Pilipinas na umapela sa international community na pigilan ang Kuala Lumpur sa paglabag sa karapatan pantao ng mga Pilipino sa Malaysia.
"The Philippine government, in addition to espousing the rights of its nationals, should also demand that the international community should ask Malaysia to cease and desist from further breaching human rights law. It should later be asked to pay compensation to the victims for its use of disproportionate use of force," sabi ni Roque.
