Insidente sa Tubbataha maaaring dahilan sa pagbasura sa VFA

MANILA, Philippines – Tatakbo sa Korte Suprema si international law expert Harry Roque upang hilinging utusan nito ang administrasyon ng Pangulong Aquino na i-renegotiate ang Visiting Forces Agreement (VFA) kaugnay ng pagsadsad sa Tubbataha Reef ng isang US minesweeper noong Enero 17.

Ayon kay Roque, maghahayin siya sa Korte Suprema ng petisyon upang maglabas ng writ of execution.

Sasamahan si Roque ng civil society groups sa paghahayin ng naturang mosyon.

Sinabi ng abogado na ang pagsadsad ng USS Guardian sa Tubbataha National Park ang nag-udyok sa kanya na maghayin ng motion for execution.

"As far as we know, the minesweeper had no business and was asked not to enter the national park. We theorized that the US Navy personnel on board may have wanted to engage in scuba diving in the park. That makes their grounding there a 'non-service related' event. The captain and the men of the minesweeper should have been criminally prosecuted before our local courts. This is an instance where the Court's ruling in Salonga could then apply," pahayag ni Roque.

Sa kanyang mosyon, gusto ni Roque na muling pag-usapan ng gobyerno ng Pilipinas at ng Estados Unidos ang VFA.

Aniya maaaring gawing dahilan ang insidente sa Tubbataha Reef upang mabasura na ang naturang kasunduan.

"The Tubbataha incident makes it very clear why the VFA is not beneficial to the Philippines. It gives the Americans a pretense to ignore our national sovereignty and destroy our national patrimony. Before, the Americans raped only our women. Now, like victorious conquering forces, they are raping our national wealth as well," sabi ni Roque na direktor din ng Institute of International Legal Studies ng UP Law.

"I am not aware of writ of execution issued by the Supreme Court. Normally, it is a lower court that issues the writ. But there is no prohibition. The Supreme Court as guardian of the Constitution may be looked upon to assert Philippine sovereignty," dagdag niya.

Si Roque rin ang naghayin ng naunag petisyon sa Korte Supreme na humihiling na ideklarang labag sa batas ang VFA kaugnay naman ng puwersahang pagkuha ng US kay US Marine Lance Corporal Daniel Smith na nakasuhan noon ng kasong panggagahasa sa Pinay na si “Nicole.”

Sinabi ng mataas na hukuman na naaayon sa saligang batas ang VFA pero ang petisyon ay naging “partially granted.”
