Badoy gustong ipa-'cite in indirect contempt' sa Korte Suprema dahil sa posts vs Manila judge

MANILA, Philippines — Pormal nang naghain ng petisyon para sa "indirect contempt" laban kay dating NTF-ELCAC spokesperson Lorraine Badoy ang ilang abogado, law school deans atbp. kaugnay ng mga atake ng nabanggit sa isang hukom sa Maynila.

Kaugnay ito ng red-tagging at diumano'y "pagbabanta" ni Badoy sa buhay ni Manila Regional Trial Court presiding judge Marlo Magdoza-Malagar, na nagbasura sa petisyong ipadeklarang iligal at terorista ang rebeldeng Communist Party of the Philippines at New People's Army.

Inihain ang "Urgent Petition for Indirect Contempt" ng ilang legal luminaries, private law school deans at law practitioners sa Korte Suprema, Martes.

"We're filing today a petition for indirect contempt... [for] several posts concerning the resolution of judge Malagar," ani Atty. Rico Domingo, dating presidente ng Philippine Bar Association at chairperson ng Movement Against Disinformation.

"We believe that considering the gravity... we believe that it should be punishable with indirect contempt."

Ayon sa Secton 3 (d) ng Rule 71 ng Rules of Court, tumutukoy ang indirect contempt sa "[a]ny improper conduct tending, directly or indirectly, to impede, obstruct, or degrade the administration of justice."

 

Kung mapapatunayang nagkasala, maaaring patawan ng hindi lalagpas sa P30,000 multa o pagkakakulong na hindi lalagpas sa anim na buwan si Badoy, ayon pa kay Domingo.

"It's not the penalty that we're talking about here. It's the gravity and the omimous danger to the independence of our judicial system," dagdag pa niya.

"Otherwise there will be chaos."

Una nang binalaan ng Supreme Court ng contempt si Badoy dahil sa mga pasaring nitong pag-"incite ng violence" gamit ang social media atbp. paraan para ilagay sa peligro ang buhay ng mga hukom at kanilang mga pamilya.

Matatandaang pinaskil ni Badoy ang mga sumusunod ilang linggo na ang sumusunod patungkol kay Malagay:

So if I kill this judge and I do so out of my political belief that all allies of the CPP NPA NDF must be killed because there is no difference in my mind between a member of the CPP NPA NDF and their friends, then please be lenient with me.

Kamakailan lang nang dumepensa ang anti-communist figure, na kilala sa pag-red tag ng mga ligal na mga aktibista't mga personalidad, sa warning ng SC at sinabing hypothetical lang ang kanyang mga binanggit ay hindi totoong pagbabanta.

"Clearly, the unabashedly persistent and contumacious series of social media posts insinuating that the Hon. Marlo Magdoza-Malagar is part of the communist movement or, at the very least, is a staunch supporter, are the very acts that this Honorable Court aims to address being the acts that threatens the safety and security of judges," sabi pa ng petisyon.

"It is slanderous, unfair, abusive, criminal. Respondent has threatened the life and security of Judge Malagar and her husband; subjected them to slanderous accusations; and through her actions, called on and encouraged the public to do the same. This is truly detrimental to the independence of the judiciary and grossly violative of the duty of respect to courts."
