LAGUNA, Philippines – The Calamba City prosecutor’s office approved on Friday the filing of criminal charges against five suspects in the robbery-slay of former Department of Tourism executive and Philippine STAR reporter Nixon Kua in Barangay Maunong, Calamba City last July 21.
In a five-page resolution, city prosecutors Miguel Noel Ocampo and Angelina Mailom-Orendain said probable cause that the suspects committed the crime has been established.
The prosecutors recommended the filing of robbery with homicide charges against John Rey Cortez, Noel Garcia, Darwin Saniano, Michael Motel and a John Doe. They also recommended the filing of frustrated homicide against the suspects for the wounding of Allyxon, Nixon’s brother.
The prosecutors said positive identification deserves greater weight and credit as against the alibi of the accused. “The alibi is a weak defense even if it is supported by the testimony of friends of the accused,” they said.
The robbery-slay occurred at around 8 p.m. inside the Ayala Greenfields Subdivision.
