Jayme had filed administrative and criminal complaints against Osmeña, owing to the incident during the signing of a Memorandum of Agreement at the mayors office.
Ombudsman Director Virginia Palanca-Santiago said Osmeña has 10 days from the receipt of the order to file his counter-affidavit.
Osmeña is currently in the US for a vacation and medical check-up, after he suffered a hypertensive attack while attending a wedding last February.
In his complaint, Jayme said that on Jan. 25, he attended the signing of a MOA between the City of Cebu and Sky Foundation, Inc., upon the invitation of Councilor Manuel Legaspi.
"Without provocation, and acting without justness, without sincerity, discriminating against my person, and without giving respect to my right as a taxpayer and a simple barangay captain, (Osmeña) pointed at me, and haughtily and arrogantly shouted at me," Jayme said. Freeman News Service
