Leyson has been vocal about his intention to run for the mayoralty post in Talisay next year. He applied for a transfer of residence last year claiming his roots come from the city.
In his application form submitted to the COMELEC, Leyson, 63, single, stated that he has been residing in barangay Lagtang for four years. He came back late June to complete his application, as during the time he did it the COMELEC's data capturing machine was out of order.
Election Officer Corazon Moran said the board will only be administering the law, and after it approves Leyson's application, anyone can dispute his claim.
"They can always file a petition for exclusion from the list (of candidates)," said Moran.
Leyson could also be liable, she added, as he was under oath when he filed his application.
Leyson, who has been a councilor of Cebu City for two terms already, is a registered voter of barangay Cogon Ramos, Cebu City. - Liv G. Campo
