Fiscal OKs murder case vs suspect in Charice dad's slay

LAGUNA, Philippines  – The provincial prosecutor’s office yesterday approved a resolution to file a murder case against the self-confessed killer of the father of international singing sensation Charice before the court in San Pedro town.

In a phone interview, provincial prosecutor George Dee told The STAR that they found elements of treachery and unlawful act after carefully evaluating the statements of witnesses and other pieces of evidence, including the counter-affidavit submitted by the legal counsel of suspect Angel Capili.

Dee said Capili’s camp failed to prove self-defense, which the suspect had invoked in fatally stabbing Ricky Pempengco last Oct. 31, saying his alibi was not strong to downgrade the charge against him from murder to homicide.

Dee said they have issued a resolution to file a criminal case before the San Pedro regional trial court, which will raffle it off next week.
