CEBU, Philippines - Aside from the exclusion case, defeated mayoralty candidate Lemar Alcover, is facing another complaint.
This came after Rosa Cristy Quidlat, through her lawyer Julius Caesar Entise, filed a criminal complaint for a violation of Section 261 (e) of the Omnibus Election Code before the Cebu City Prosecutor’s Office.
Quidlat earlier filed an exclusion case against Lemar before the Municipal Trial Court in Cities after he allegedly failed to meet the mandated six months residency pursuant to Commission on Election Resolution No. 9716 known as the Rules and Regulations on the Resumption of the System of Continuing Registration of Voters.
This was dismissed by the court due to a technicality, but Entise told The FREEMAN that the exclusion case is pending for appeal before Judge Raphael Yrastorza of Regional Trial Court Branch 14.
Lemar is the son of Alliance for Nationalism and Democracy Party-list Rep. Pastor “Jun†Alcover.
In her complaint, Quidlat, a resident of Sitio Cabulihan, Barangay Sambag 1, Cebu City, alleged that she knew Alejandro Bacus, the father of Francis Kim and Chona Baquiano, mother of Shane. She said Francis Kim and Shane were 18 years old. However, she said she was surprised when the two were registered under the Sangguniang Kabataan.
“…I was very surprised to learn that their children; to wit: Francis Kim Bacus and Shane Baquiano were registered for the SK Elections in Barangay Sambag1, Cebu City, when they are not qualified to be members of the Katipunang Kabataan,†the affidavit read.
Aside from Lemar, Quidlat named Dennis Lauranilla, Regino Alcarez, Sherwin Agunias and Richard Abella, all residents of Sambag 1, as respondents in the complaint.
To support her allegations, Francis Kim and Shane executed an affidavit.
Francis Kim alleged that on July 27, 2013 after playing basketball, he and his companions were told by Lauranilla to go to the headquarters of ANAD Partylist.
There, he said Lauranilla told them to fill up an application for registration as a member of the Katipunang Kabataan as it was required for them to play in the basketball league.
Aside from Lauranilla, Francis Kim said he saw Alcarez, Agunias and Abella in the headquarters.
“…I filled up the application for registration above-mentioned but I told them that I don’t have a copy of my birth certificate. That Dennis Lauranilla told me that the absence of my birth certificate is not a problem because they will just make a birth certificate for me,†his affidavit read.
Three days after he filled up the application, he said he was brought to the Comelec office to file his application for registration under the condition he will be given P100 by Lemar. However, he said he was only given P50.
Shane said on the same day after playing basketball they were told to go to the ANAD headquarters. He claimed that he filled up the application for registration, but never went to Comelec Office to file his application.
He added he was surprised upon learning that he was registered as a member of the Katipunang Kabataan for the SK Elections.
With that, he asked that his registration with Katipunang Kabataan be cancelled as he was registered with the Comelec as a regular voter for the Barangay Elections.—(FREEMAN)
